There are several documents in Greece that are regulating the Building Code. The main legal framework for buildings is defined in the Building Regulation (M.D. 046/304/1989, ΦΕΚ 59/Δ/3.2.89) for the construction of buildings, and the Generic Building Regulation (Law 4067/4-2012) mainly for the terms of building.
The terms and conditions for the installation of PV systems on buildings are dealt mainly by the following Ministerial Decrees of the Greek State that reflect the adoption of European Directives, International and European standards and best practices as well as the adoption of measures due to national and local issues:
M.D 36720 ΦΕΚ 376: ‘Specific conditions for the installation of photovoltaic and solar systems on buildings and land within building plan areas and in settlements’
M.D. 40158 ΦΕΚ 1556: ‘Specific conditions for the installation of photovoltaic and solar systems on buildings and land outside of building plan areas’ and modifications made by ΦΕΚ 583:2011.
According to the M.D 36720 ΦΕΚ 376:
The installation of photovoltaic systems whether are power systems and solar space heating and cooling on buildings, as defined in Article 2 paragraph 17 of n.1577/1985 are allowed if the roof is erected on a lawfully existing building, including shelters terraces, facades and awnings, as defined in Paragraph 6 of Article 11 of N.1577/85, as applicable, pursuant to paragraph 1a of Article 16 of the Act, where applicable and in force.
The installation of photovoltaic systems on roofs is permitted where the required building works are not contrary to specific building terms applicable to the area.
No person shall install photovoltaics and solar space heating and cooling over and by the end of the elevator shaft and stair well.
The arrangement of photovoltaic cells and solar cooling and space heating systems should not create main space or auxiliary use space or semi-outdoor space or obstruct access to public areas. These facilities will be limited to the contour of the floor. If mounting on a roof, it should be within the volume of the roof, along the slope, such as to ensure the aesthetic image of the building.
Photovoltaic systems and solar cooling and heating blocks should be integrated with other structures under Article 16 of n.1577/1985, where applicable and in force, so that they do not affect the aesthetics of the building and the environment
If photovoltaic and solar space heating and cooling systems are installed on the roof of a building, the distance from the parapet of the roof should be at least 0.5 meters for safety reasons.
According to the M.D. 40158 ΦΕΚ 1556:
The installation of photovoltaic and solar systems for heating and cooling space is allowed after issuing a small scale works approval, for works concerning the installation to open spaces and land plots located in areas within the building plan areas (BPA) and within specific conditions for the installation of photovoltaic and solar systems on buildings and open spaces, as per Resolution RES 3 18/04/2011. For systems installed within settlements in accordance with the provisions of paragraph 2 of Article 3 of the Special Land Use Framework for RES.
